TERMS AND CONDITIONS

PREAMBLE

​Amandine Cagnin handcrafts ceramic objects in her workshop (hereinafter the “Products”) which she markets through the website https://amandinecagnin.com/ (hereinafter the “Website”).

​

ARTICLE 1 - PURPOSE

​These terms and conditions of sale (hereinafter the « Terms ») govern the sale of Products offered by Amandine Cagnin to its customers (hereinafter individually or collectively the “Customer”) through the Website.

Any order placed on the Website implies full and unconditional acceptance of theTerms.

Amandine Cagnin reserves the right to amend the Terms at any time. The Terms applicable are those in force on the date of payment of the order.

 

ARTICLE 2 - PRODUCTS

​Amandine Cagnin presents the Products as well as their essential characteristics, including their respective prices, on the Website.
The photographs, illustrations and descriptions of the Products are as accurate as possible but cannot guarantee an exact similarity with the Product offered for sale. As each Product is handcrafted, variations may occur from one item to another within the same series.

ARTICLE 3 - PRICE

​The prices of the Products are indicated in Euros and are net of tax, as VAT is not applicable pursuant to Article 293 B of the French General Tax Code, and are exclusive of delivery costs.

Delivery costs will be specified to the Customer at the time of order confirmation and vary according to the destination of the order, the weight, as well as the volume of the Product ordered. Delivery costs are determined based on the current postal and carrier rates.
For all Products shipped outside the European Union, customs duties or all local taxes are the exclusive responsibility of the Customer. 

Amandine Cagnin reserves the right to modify her prices at any time. However, such modification shall not affect current orders, which shall be invoiced on the basis of the prices in force at the time of validation of the Customer’s order confirmation.

 

ARTICLE 4 - PAYMENT

​Payment is due immediately upon ordering and shall be made by credit card (Mastercard or Visa for cards issued by banks domiciled outside France). Secure online payment is processed by the payment service provider Stripe. 

It is specified that an order shall be deemed confirmed only after full receipt of payment of  for the total amount of the order. Amandine Cagnin reserves the right to suspend or cancel any order in the event of a refusal of payment authorization by officially accredited financial institutions or in the case of non-payment. 

The Products shall remain the property of Amandine Cagnin until full payment of the price.

ARTICLE 5 – DELIVERY

​Delivery of the Products shall be made to the address provided by the Customer at the time of ordering, within the standard delivery times of the Colissimo postal service, depending on the delivery destination. It should be noted that the order preparation time—carried out within fifteen (15) business days following order confirmation—is not included in the standard Colissimo delivery times indicated above. For made-to-order Products, this period may be extended up to eight (8) weeks.

Amandine Cagnin shall not be held liable in the event of an incorrect delivery address provided by the Customer.

Once the Customer takes physical possession of the Products, the risk of loss or damage to the said Products passes to the Customer. Consequently, it is the Customer’s responsibility to notify the carrier of any reservations concerning the delivered Product.

 

ARTICLE 6 – RIGHT OF WITHDRAWAL

In accordance with Article L.221-18 of the French Consumer Code, the Customer has a period of fourteen (14) days from the date of receipt of the Products to exercise their right of withdrawal, without having to provide any reason or pay any penalty, except for the return shipping costs, which shall remain the responsibility of the Customer.

The Customer may exercise their right of withdrawal by sending a written request by email to the following address: amandinecagnin.ceramique@gmail.com.

The Product must be returned in its original packaging, intact, in perfect condition for resale and, if possible, accompanied by a copy of the proof of purchase.

Amandine Cagnin will refund the total amount of the order, excluding return shipping costs, within thirty (30) days following receipt of the returned package.

 

 

ARTICLE 7 – LEGAL WARRANTIES

Amandine Cagnin undertakes to comply with the legal warranties for conformity and hidden defects provided for respectively by Articles L.217-4 et seq. of the French Consumer Code and Article 1641 of the French Civil Code.

The enforcement of these warranties must be requested in writing by email at the following address: amandinecagnin.ceramique@gmail.com.

The claim must be justified and accompanied by the relevant supporting documents.

The Product must be returned in its original packaging, intact, in perfect condition for resale and, if possible, accompanied by a copy of the proof of purchase.

Amandine Cagnin will refund the total amount of the order, excluding return shipping costs, which remain the responsibility of the Customer, within thirty (30) days following receipt of the returned package.

 

ARTICLE 8 – COMPLAINTS AND MEDIATION

​The Customer may submit any complaint by contacting Amandine Cagnin at the following email address: amandinecagnin.ceramique@gmail.com.
In accordance with the provisions of the French Consumer Code regarding the “consumer dispute mediation process,” the Customer has the right to use free of charge the mediation service offered by the European Online Dispute Resolution (ODR) platform.
This mediation service can be accessed online via the following website: https://consumer-redress.ec.europa.eu/index_fr .

 

ARTICLE 9 – INTELLECTUAL PROPERTY RIGHTS

​All elements appearing on the Website, whether visual or audio, as well as the Products sold on the Website, are protected by copyright and other intellectual property rights. They are the exclusive property of Amandine Cagnin. No transfer of intellectual property rights is made under these Terms. Any unauthorized reproduction, representation, adaptation, or exploitation of all or part of these elements is strictly prohibited.

ARTICLE 10 – APPLICABLE LAW AND JURISDICTION

These Terms are governed by French law.
In the event of a dispute, an amicable solution shall be sought as a priority. Failing an amicable agreement, the French courts shall have exclusive jurisdiction.
